Milan Mandaric’s bid turned down. Is this why?

The Birmingham Mail are saying that Milan Mandaric has had a bid for the club turned down, even though it met Xia’s financial demands and I’m again wondering why?

And then it turns out that Wyness isn’t suing for “wrongful dismissal”, but is accusing Xia of “tortious interference” instead;

No, I didn’t know what it was either, but put simply, it’s where an owner prevents an officer from complying with his legal obligations.

The article states that “the implication would be that he was prevented from seeking insolvency advice and / or investment for AVFC by Xia, despite his fiduciary responsibilities to do so.”

Which is pretty much what we thought.

The interesting or probably worrying part though, is the following;

“The further implication of this is twofold; that Xia cannot let the club go into administration nor can he sell the club.”

Now, I don’t quite understand this, as it seems to me that if Xia sells, there would probably be some sort of agreement to sort out the debts.
But it’s always possible that I’m missing something, in which case perhaps you can enlighten me?
Is it the fact that Xia is being sued that makes it impossible for him to sell?
I don’t know, but whoever is leaking this stuff seems to know what they’re talking about and it certainly fits with Xia’s statement that the club isn’t up for sale.

I’m not sure if I fancy Mandaric coming in. From memory it seems fans loathed him, but there’s no doubt he leaves clubs on a much better footing and if that’s what’s required, maybe he might be good for the club, if not us supporters.

Whatever, if this story is true, it’s all very worrying, as we might very well be stuck in total limbo.

    i think we should all sign up, on the best meditation course available, its nearly start of the season so iam well happy, saturdays is my only free day and villa playing is all that i care about.

    this season is a free swing, if the kids are all messi’s we will walk away with the tittle. if they are not all that, we are going to be in for a long hard to take season. but will be fun seeing the kids blooded wont it

    i heard the games on youtube today 3pm i will rather watch them than englands friendly with belgium

    Badger, something thing very fishy going on here.I’ve read the links you place in and its very confusing. I’m going to be honest that i don’t trust Xia, he’s playing games with Villa and the outcome we WILL suffer, I think Wyness did the right thing and the Chinese chump wants to break the law and Villa going to suffer.he knows that players like Grealish, Chester, and possible four other will get his money back then sell. I don’t trust Xia.

    how many weeks has the transfer window been open and how many players have been sold. we will have to sell anybody we can, because we are not gonna be able to rely on selling the players we most desire to go.

    if jedi goes that will be a big bonus, chester i cant see how he will stay hes gonna be sold if they get 10 million for. because his wages are 40k. lansbury another 40k we cant afford and hes more likely to stay, because we wont have any buyers for him.

    our biggest asset is grealish he will go, even thou hes not a hight earner. because they need money and he is the one player other clubs will want and at a high enough figure to make a difference to the debt in ffp

    we should start to worry if and when the clubs start coming in for players like murphy green davis types

    I don’t see why Wyness’ action would prevent Xia either selling or putting the club into administration as he, himself, as an officer of the company has fiduciary obligations under Company Law. I also wonder whether the action being taken by Wyness is personal against Xia or the company.

    It comes back to the question of whether Xia is his own master.

    Whatever, it is not good news.

    Cheers Badger, I’ve got the panel talking on England’s game coming on now. The very thing we picked up on was a creative midfield player like Grealish, how is it thought about now when its gone. That stood out a mile in all England’s games, I’m back to watching Villa at Kiddy.

    I’ve been thinking about this again while watching England’s poor performance.

    I think what the Villaleaks article is implying, is that if Xia sells or puts us into administration, it’s an admission that Wyness was indeed acting correctly and leaves him on a very sticky wicket.
    Does that make sense?

      So why did Xia reject the bid? The owner must now face questioning from all angles. Promising bids are coming in for the club – they won’t save players like Jack Grealish – but they will ensure Villa can pay the bills. The latter is incredibly important. Could this be another gamble by the owner? Will he chance Villa getting promoted so he can sell at a higher price?

      It’s getting bizarre at Villa, and that is only pushing fans and critics of the club to jump to a number of conclusions. The entire situation isn’t helped by leaks and reports that point to a different truth than the one we may be acknowledging. We all thought recently-dismissed CEO Keith Wyness would be suing the club for ‘unfair dismissal’, when news has broken that he’ll likely be taking a tortious inference case forwards. This reveals a whole new story – that Wyness was dismissed for ‘doing his job’ – be that finding new investors, or taking the club into administration to prevent it from being actively harmed. We’ll wait to see what comes of that before making a conclusion. If you want some opinion though, I’d bet my last fiver on Tony Xia waiting on this until the last minute as he needs to save face with his domestic backers. He won’t deal with people outside of China and will keep the club, with administration probably the only thing that will tear him out of it.

      I sincerely hope that my opinion doesn’t match the facts to come. I just want everything to go back to the way it was, but it can’t. It’s too late now. Who knows how this will unfold

    Yes, every bit, Xia playing games with the club, and FA. He’s on a dangerous mission the way he’s playing the law of football.I feel time will tell and an investigation will come in.

    So, pride and self preservation seems to be what is preventing the sale of the club or injection of investment… not sure this is helping with my anxiety.

    Mandaric, sure – if he can get Xia to the table. He’s a shark, but a football shark with a proven record of leaving a club in a better position. I could care less if he makes millions in the process, as long as, the club becomes financially sound and pushes for promotion. Compared to Lerner and Xia, who have run the club down over years of gambles and general inexperience regarding running a football club, I would gladly welcome Mandaric.

    i apologise for my latest post but i speak as i see it.

    both suliman and bedeau looked well below championship standards. i hear grumbles for signing other clubs youths. but here is the point. we can only play our youths if they are almost ready. also in positions like centre back their are no hiding places. they are not even close to the standards required.

    elphick looked decent he was always coaching suliman through the game. chester was doing likewise to bedeau, who looked the better of the two. made some good one on one challenges.

    i will bare in mind this was first game of preseason. but on this evidence we need another centre back to partner elphick if / and when chester leaves.

    Mandaric saying he hasn’t nor is he interested in buying AV but is ‘advising’ a potential group of investors interested in taking a minority stake. Can’t believe anything you read in the media!

    Ok, I don’t like post coming in between posts ignoring post trying to make a point, Badger, you might be the owner but I’d like to have respect , I might be the oldest, but I have the privileges
    to have worked at to club, you lot haven’t, I don’t know why Dean disappear as part owner so I’m asking why., I know can see thinking what I ask is not ilrevelent., I have more interest in the club than all of you, this might be my last input it’s up to you., I love my club like most of you, but give me respect.
    I’m saying this as a dedicated poster.

      Hi Bill, sorry you feel your post(s) were / are ignored. Not the case for me. Although didn’t reply directly think many of your points have been picked up in the ensuing debate.

      On the face of it, Xia is playing a dangerous game as you so rightly point out; the real problem being that we just don’t have enough reliable information on which to base an opinion.

      I think Badger called it right when he suggested that Xia has backed himself into a corner over the Wyness situation and OLL (I think I’m right in saying) has consistently maintained that Xia is a ‘front man’ for other Chinese investors.

      Only time will tell whether or not Xia comes under investigation but, if he does, then it may be from authorities other than the EFL.

      On the Oohah point; I never got the impression he was a ‘dyed in the wool’ Villa fan and credit to Badger – he runs a good blog and IMHO is very fair in the way he deals with posts / posters.
